Website Terms of Use

These Terms of Use (these “Terms”) govern your access to and use of the website at stonyp.com and its subdomains (the “Site”), operated by Stony Point, Inc., a Florida corporation, doing business as (“d/b/a”) Digadop (“Stony Point,” “we,” “us,” or “our”), 8742 Peachtree Park Ct, Windermere, FL 34786. Stony Point operates a Salesforce training and consulting business through the Site. By accessing or using the Site, you agree to these Terms.

These Terms govern the informational and marketing Site only. They are separate from, and do not replace: (a) the Stony Point Training Registration Terms, which govern enrollment in and purchase of training; (b) the Stony Point Consulting Services Agreement, which governs paid consulting engagements; and (c) the master terms that govern the Digadop software products (the Digadop Terms of Service, Privacy Policy, and Data Processing Addendum). Where you enroll in training, engage consulting, or use a Digadop product, the applicable agreement for that activity governs that activity, and these Terms govern your general use of the Site.

1. Who we are and acceptance

1.1 The Site is operated by Stony Point, Inc., a Florida corporation, d/b/a Digadop. By accessing or using the Site, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

1.2 We may update these Terms from time to time. Changes take effect when we post the updated Terms with a new effective date. Your continued use of the Site after a change means you accept the updated Terms.

2. Use of the Site

2.1 Permitted use. You may use the Site for lawful, personal, and business-evaluation purposes, including learning about our training and consulting services, accessing published resources, and contacting us.

2.2 Prohibited use. You will not: (a) use the Site in violation of any law; (b) attempt to gain unauthorized access to the Site, its servers, or any connected system; (c) interfere with or disrupt the Site’s operation or security; (d) scrape, harvest, or collect information about other users; (e) upload or transmit malware or any harmful code; (f) misrepresent your identity or affiliation; or (g) use the Site to send unsolicited communications.

2.3 Eligibility. You must be able to form a binding contract to use the Site. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Forms, inquiries, and communications

3.1 Information you submit. When you complete a form, request information, register interest, or contact us, you provide the information described in our Privacy Policy. You are responsible for the accuracy of what you submit and for having the right to share any information you provide about a third party.

3.2 Marketing communications. If you opt in to receive marketing communications, we may contact you consistent with our Privacy Policy and applicable law (including CAN-SPAM and, where applicable, CASL). Every marketing email includes a way to unsubscribe, and you can opt out at any time. Transactional messages about a training registration or a consulting engagement you have with us are not marketing messages.

4. Intellectual property

4.1 Our content. The Site and its content, including text, graphics, logos, course descriptions, curricula outlines, resources, and the “Stony Point” and “Digadop” names and marks, are owned by or licensed to Stony Point and are protected by intellectual-property laws. Except as expressly permitted, you may not copy, reproduce, distribute, publish, or create derivative works from Site content without our prior written consent.

4.2 Limited license. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for the permitted uses above. This license does not include any resale or commercial use of the Site or its content, or any use of our marks.

4.3 Training materials are separate. Access to and use of any training curriculum, course materials, or deliverables is governed by the Training Registration Terms or the Consulting Services Agreement, not this Section.

5. User submissions

5.1 If you submit content to the Site (for example, an inquiry, comment, testimonial, or other material), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for the purpose of operating the Site and responding to you, and, for a testimonial or review you provide, for our marketing where you have permitted that use. You represent that you have the rights to grant this license and that your submission does not violate the rights of any third party or any law.

5.2 We do not want to receive, and you should not submit, any confidential or proprietary information through a general Site form or any special category of personal data. Contact us through the appropriate channel for a confidential discussion.

The Site may link to or integrate third-party websites, registration or event platforms, or services that we do not control. We provide these for convenience and are not responsible for their content, policies, or practices. Your use of a third-party site or platform is governed by that third party’s terms and privacy notice.

7. Disclaimers

7.1 The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any information on the Site is complete or current.

7.2 Site content is for general informational purposes and is not professional, legal, or technical advice. Descriptions of training and consulting services on the Site are marketing summaries; the binding terms of any training or consulting are in the applicable agreement.

8. Limitation of liability

8.1 To the fullest extent permitted by law, Stony Point will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business, arising out of or relating to your use of or inability to use the Site.

8.2 To the fullest extent permitted by law, Stony Point’s total aggregate liability arising out of or relating to the Site and these Terms will not exceed USD 100. Liability for training or consulting is governed by, and capped in, the applicable agreement for that activity, not this Section.

8.3 Nothing in these Terms excludes or limits either party’s liability for (a) gross negligence, willful misconduct, or fraud, (b) death or personal injury caused by its negligence, or (c) any other liability that cannot be excluded or limited under applicable law.

9. Indemnification

You will defend, indemnify, and hold harmless Stony Point and its officers, directors, employees, and agents from and against any third-party claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site in breach of these Terms or applicable law, or any content you submit. This does not apply to the extent a claim is caused by our own breach, negligence, or willful misconduct.

10. Governing law and venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. The exclusive venue for any dispute arising out of or relating to the Site or these Terms is the state and federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts, subject to any right you have under the law of your home jurisdiction that cannot be waived. Because our training is offered worldwide, a visitor or registrant may have non-waivable local-law rights that override this Section for that person.

11. General

11.1 Entire agreement for the Site. These Terms, together with the Privacy Policy, are the entire agreement between you and Stony Point regarding your general use of the Site, and supersede any prior understanding on that subject.

11.2 Severability. If any provision is held unenforceable, the remaining provisions stay in effect.

11.3 No waiver. Our failure to enforce a provision is not a waiver of it.
