Training Registration Terms
These Training Registration Terms (these “Terms”) govern your registration for and participation in a training course, class, workshop, or program (each, a “Course”) offered by Stony Point, Inc., a Florida corporation, doing business as (“d/b/a”) Digadop (“Stony Point,” “we,” “us,” or “our”), 8742 Peachtree Park Ct, Windermere, FL 34786. Stony Point offers Courses worldwide, delivered live in person, live virtual, self-paced, or a combination, as each Course description states. By registering for a Course, you agree to these Terms. If you register on behalf of an organization or another attendee, you represent that you are authorized to do so and to bind them to these Terms.
These Terms apply to Course registration and participation. They do not apply to free webinars or other free events, which are not Courses. Your general use of the stonyp.com website is governed by the Website Terms of Use, and our handling of your information is governed by the Privacy Policy. A paid consulting engagement is governed by the separate Consulting Services Agreement.
1. Registration and confirmation
1.1 Registration. You register for a Course through the Site or an authorized registration platform by providing the requested information and paying the applicable fee (or arranging payment as we permit). Your registration is not confirmed until we accept it and, where a fee applies, we receive payment or an approved purchase commitment.
1.2 Seat availability. Course seats are limited and offered on a first-registered, first-served basis. We may close registration when a Course is full.
1.3 Accurate information. You are responsible for the accuracy of the registration information, including attendee names and contact details, and for keeping it current so we can deliver Course communications.
2. Fees and payment
2.1 Fees. The Course fee is the amount stated at registration. Fees are in US dollars unless stated otherwise, and are exclusive of any applicable taxes (including sales tax, VAT, or GST), which are your responsibility. All Courses are paid; free webinars and events are not Courses and carry no fee.
2.2 Payment. For a public Course, payment is due in full at registration. For a private Course delivered under a written agreement, payment is 50% due on signature of the agreement (and in any event before the Course begins) and 50% due on completion of the Course, unless the agreement states otherwise. Online registrations are processed through our third-party payment processor (currently PayPal, transitioning to Stripe); by paying, you also agree to that processor’s terms. Where we invoice you (for example, for a private Course or an approved purchase-order arrangement), we invoice through QuickBooks Online and payment is due as the invoice or agreement states.
2.3 Non-payment. If payment is not received when due, we may cancel your registration or deny admission to the Course.
3. Cancellation, refunds, transfers, and rescheduling
3.1 Your cancellation and refunds. If you cancel 14 or more days before the Course start date, you receive a full refund. If you cancel at least 7 but fewer than 14 days before the start date, you receive a 50% refund. If you cancel fewer than 7 days before the start date, or you do not attend (a no-show), the fee is non-refundable. In the non-refundable cases, you may instead reschedule into a future session of a Course, and you may retake the same Course at no additional charge for up to 6 months.
3.2 Transfers and substitutions. You may transfer your registration to a later session or substitute a different attendee before the Course begins, at no fee.
3.3 Our cancellation or reschedule. We may cancel or reschedule a Course (for example, for insufficient enrollment, instructor unavailability, or events beyond our reasonable control). If we cancel a Course and do not offer an acceptable alternative, we will refund the fees you paid for that Course. We are not responsible for your travel, lodging, or other incidental costs, and our liability for a cancellation or reschedule is limited as stated in Section 7.
3.4 No-show. If you do not attend and do not cancel within the windows in Section 3.1, the fee is non-refundable, but you may reschedule into a future session and may retake the same Course at no charge for up to 6 months, as stated in Section 3.1.
4. Attendance and conduct
4.1 Participation. You will attend the Course as scheduled and meet the prerequisites and technical requirements for that Course. Each Course outlines its own requirements, and we email you a copy of the requirements for your Course before it begins (for a virtual Course, for example, a suitable device and internet connection).
4.2 Conduct. You will behave professionally and lawfully during the Course and will not disrupt the Course or other attendees. We may remove an attendee for disruptive, unlawful, or harassing conduct without refund.
4.3 Recording. You may not record, photograph, or stream the Course or its materials without our prior written consent. We may record a virtual Course for delivery and quality purposes and will handle any recording consistent with the Privacy Policy.
5. Course materials and intellectual property
5.1 Ownership. All Course materials, including curricula, slides, exercises, datasets, and handouts, are owned by or licensed to Stony Point and are protected by intellectual-property laws.
5.2 License to you. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Course materials for your own internal learning and reference. You may not reproduce, distribute, resell, publicly display, or create derivative works from the materials, or use them to deliver competing training, without our prior written consent.
5.3 Feedback. If you give us feedback about a Course, we may use it to improve our offerings without obligation to you.
6. Certificates and outcomes
6.1 On request, we issue a certificate of completion that reflects your attendance or completion as we define it. We do not award any accredited certification, formal credential, or continuing-education credit, and a certificate of completion is not a guarantee of any specific result, employment outcome, or third-party certification.
6.2 We do not guarantee that a Course will meet your particular objectives. Course descriptions are summaries and may change.
7. Disclaimers and limitation of liability
7.1 Disclaimer. Courses and materials are provided “as is.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
7.2 Limitation. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to a Course and these Terms will not exceed the fees you paid for that Course. We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business.
7.3 Non-waivable liability. Nothing in these Terms excludes or limits liability for (a) gross negligence, willful misconduct, or fraud, (b) death or personal injury caused by negligence, or (c) any other liability that cannot be excluded or limited under applicable law.
8. Privacy
We process the personal data you provide for registration and participation as described in the Privacy Policy, including its Section on the Stony Point training and marketing website. Attendee data you provide about others must be shared with their knowledge and consistent with applicable law.
9. Governing law and general
9.1 These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, and the venue for disputes is the state and federal courts located in Orange County, Florida, subject to any consumer-protection right that cannot be waived under the law of the registrant’s home jurisdiction. Because Stony Point sells training worldwide, a registrant may have non-waivable rights under local law that override this Section for that registrant.
9.2 These Terms, together with the confirmed Course details, the Website Terms of Use, and the Privacy Policy, are the entire agreement regarding your registration. If any provision is unenforceable, the rest remain in effect.
